Subject: 9883 Setback for Decks Date: Tue, 24 Apr 1990 11:55:00 -0500 ORDINANCE NO. 9883 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO AMEND CERTAIN SECTIONS RELATIVE TO SETBACK REQUIREMENTS FOR DECKS. __________________________ WHEREAS, the staff of the Chattanooga-Hamilton County Regional Planning Commission received a request to study the setback requirements for decks; and WHEREAS, the staff has studied the requirements of other Tennessee cities and has found that the deck requirements for the City of Chattanooga are more restrictive than other comparable cities; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, the Zoning Ordinance, be and the same is hereby amended as follows: SECTION 1. That Article VI, Section 104, be deleted in its entirety and the following section substituted in lieu thereof: 104. An uncovered deck may be located ten (10) feet from the rear property lines if it: does not enroach on required side yards, easements, areas reserved for septic tank and field lines, and has a maximum deck elevation no greater than the average finished first floor elevation. 0C A porch, portico or entry landing may project into the required front yard no more than five (5) feet. SECTION 2. BE IT FURTHER ORDAINED that this Ordinance shall take effect two weeks from and after its passage as required by law.
